charged with possession or sale of Marijuana?

Unlike most of the surrounding states, in Idaho, Marijuana and THC possession or distribution is a criminal offense, carrying with it a mandatory minimum sentence as well as the potential of a $1,000 fine and jail for up to one year.

Protect Your Future with Northern County Law

Consequences of Drug Charges

Despite being legal in the surrounding states, possession of Marijuana or THC is still illegal in Idaho.  Having a drug charge such as Marijuana possession may prohibit your employment or complicate the hiring process, as well as having severe penalties.  Idaho law requires a mandatory minimum of 100 hours of community service as well as potential jail time or fines.

Defenses to Drug Possession

Most frequently, drug possession charges arise from traffic stops for minor infractions.  Law enforcement cannot present or use any drugs or evidence found on these stops unless they first show that the traffic stop was valid.  Hiring an experienced attorney to analyze your case can be the best way to exclude any evidence of drugs or drug possession and protect your record.

Out of state resident?

If you are a resident of Montana, Washington, or any other state where Marijuana is legal, misdemeanor charges for drug possession may pose even more of a burden, requiring you to travel long distances to make court appearances.  At Northern County Law, we understand the time requirements of long distance travel for court appearances.  We will work to ensure that court hearings are scheduled to create the least impact on your calendar and will work with the court to approve remote appearances for our clients.
